Representative Litigation ExperienceDefended “bet the company” litigation in cases involving contract disputes, business torts, trade secrets and non-competition agreements. Litigated fiduciary and probate matters in small and large estates. Defended and pursued TROs and other injunctive relief in disputes involving trade secrets, unfair competition, breach of fiduciary duty, breach of contract and private nuisance. Lead counsel in various real property cases involving, among other things, deeds of trust, promissory notes, priority, releases, deed restrictions and lender rights Lead counsel in numerous employment discrimination matters before the EEOC Successfully represented a large Episcopal church in litigation involving the balance of free exercise and free speech rights. In a case of first impression in the state of Colorado, first-chaired a five-day bench trial, which culminated in a permanent injunction against protesters who disrupted religious services and targeted children with graphic images. Co-tried and secured a plaintiff/claimant award for the full amount of damages sought, as well as a significant portion of attorney fees and costs, in arbitration on behalf of the estate of an investor. Co-tried and obtained a complete defense/respondent award in two separate arbitrations on behalf of a national broker-dealer and an individual financial advisor. Effectively co-defended and amicably resolved five separate, multi-million dollar wage and hour class actions against four different employers. Education and Prior Legal ExperienceMr. Ball earned his undergraduate degree in Business Administration from the University of Kentucky and his Juris Doctor from the University of Virginia School of Law. During law school, David interned for the Honorable Royce C. Lamberth, United States District Judge for the District of Columbia. After graduating from Virginia, David served as a law clerk for the Honorable Karl S. Forester, then Chief Judge of the United States District Court for the Eastern District of Kentucky. Following his clerkship, David was an attorney for an international law firm based in Denver, Colorado, a boutique law firm focused on serving the needs of middle market clients, and founded his own law firm before co-founding BBU. David also served as an associate director of philanthropy for an international conservation organization.

David Ball brings more than fifteen years of business law and complex litigation experience to bear for you. As a trial attorney, he skillfully and tenaciously protects his clients’ rights and interests, but can also defuse a dispute before it spirals out of control. David is best known by his colleagues and clients as a confident, competent person who always has your best interests in mind.
Over his career, David has represented a broad range of clients in numerous industries assisting them on a wide array of transactional matters, deals, and litigation. He represents and advises clients in employment, contract, fiduciary, trade secret and business tort disputes before state and federal courts and arbitration tribunals. He has defended and secured injunctive relief in disputes involving, among other things, trade secrets, unfair competition, and breach of contract.
When in his clients’ best interests, Mr. Ball has resolved dozens of cases, on favorable terms, through negotiation, both prior to and during litigation. Mr. Ball frequently counsels and advises individuals and companies regarding problem solving, achieving objectives, litigation avoidance, dispute resolution, litigation and trial. Finally, Mr. Ball is a trained mediator.
